These Terms of Service ("Terms") govern your use of AlwaysOnPro AI's AI voice receptionist platform and services. By signing up or using our services, you agree to these Terms. Please read them carefully.

1. Services

AlwaysOnPro AI provides AI-powered voice receptionist services for small businesses, including inbound call handling, FAQ responses, appointment scheduling assistance, and call summaries. Services are delivered via cloud infrastructure and are subject to availability.

2. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the security of your credentials and for all activity under your account. You must be at least 18 years old and authorized to enter into contracts on behalf of your business.

3. Subscription and Billing

• Services are offered on a monthly subscription basis. Fees are charged at the start of each billing period.
• A one-time setup fee applies to new accounts as listed in your selected plan.
• We use Stripe to process payments. By providing payment information, you authorize us to charge the applicable fees.
• Prices may change with 30 days' notice. Continued use constitutes acceptance of new pricing.

4. Acceptable Use

You agree not to use the service to:

• Violate any applicable law or regulation
• Engage in fraudulent, deceptive, or harassing communications
• Impersonate any person or entity
• Transmit spam or unsolicited commercial messages
• Violate any call recording or wiretapping laws in your jurisdiction

5. Call Recording Compliance

You are solely responsible for complying with all applicable call recording laws, including obtaining required consents from callers. AlwaysOnPro AI provides a default disclosure announcement, but compliance remains your responsibility. You must not disable or remove the call recording disclosure.

6. Cancellation and Refunds

You may cancel your subscription at any time. Your service will continue through the end of your current billing period. We do not provide prorated refunds for unused portions of a billing period. Setup fees are non-refundable. See our Cancellation & Refund Policy for full details.

7. Intellectual Property

AlwaysOnPro AI and its licensors own all rights to the platform, software, and AI models. You retain ownership of your business data and call recordings generated under your account. You grant us a limited license to process your data to provide the services.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALWAYSONPROAI'S TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE FEES YOU PAID IN THE 3 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE. AI RESPONSES MAY BE INACCURATE — YOU SHOULD REVIEW CALL SUMMARIES AND NOT RELY SOLELY ON AI OUTPUT FOR CRITICAL BUSINESS DECISIONS.

10. Termination

We may suspend or terminate your account for violations of these Terms, non-payment, or other misuse, with or without notice. Upon termination, your access to the service ends and we may delete your data after 30 days.

11. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.

12. Changes to Terms

We may update these Terms with 14 days' notice. Continued use after notice constitutes acceptance.
